This document sets out the Privacy Policy for the librusea.pl website (the “Website”). The administrator of the librusea.pl website is Libru Sea Sp. z o.o. with its registered office in Strzeblinko 24, 84-250 Gniewino, NIP [Tax Identification Number]: 5882435434, REGON [National Official Business Register Number]: 369437580. Personal data collected by the Website Administrator are processed in accordance with the provisions of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) ( OJ EU L 119, p.  1), hereinafter referred to as the GDPR.

The Administrator of the Website makes special efforts to protect privacy and information provided to it and concerning the users of the Website. The Administrator shall exercise due care in selecting and applying appropriate technical measures, including those of a programming and organisational nature, to ensure the protection of the processed data, in particular to protect them against unauthorised access, disclosure, loss and destruction, unauthorised modification, as well as against their processing in violation of the applicable law.

Purposes and legal basis for the processing of personal data

The Controller processes your personal data for the following purposes and in the following scope:

 – for the purpose of contacting you by e-mail in order to reply to any of the messages you may send to us, we process the personal data you provide in the contact form, such as your name, e-mail address;

 – for the purpose of statistics on the use of the various functionalities of the Website, to facilitate the use of the Website and to ensure the IT security of the Website, we process personal data relating to your activity and the amount of time spent on each subpage, your search history, location, IP address, device ID, data relating to your web browser and operating system;

Voluntary provision of personal data

The provision of the required personal data is voluntary and is a condition for the provision of services by librusea.pl

Period of data processing 

Personal data will be processed for the period necessary to carry out recruitment processes, marketing activities and other services provided to the Customer. Personal data will be deleted in the following cases:

 – when the data subject requests their erasure or withdraws the consent given;

 – when the data subject does not take any action for more than 10 years (inactive contact);

 – upon receiving information that the data stored is out of date or inaccurate.

Recipients of personal data

We transfer your personal data to the following categories of recipients:

– to state authorities, e.g. the prosecutor’s office, the Police, the President of the Personal Data Protection Office, the President of UOKiK, if they request us to do so;

– to the service providers we use to operate the Website. Depending on contractual arrangements and circumstances, these entities either act on our behalf or determine the purposes and means of processing themselves.

Rights of the data subject

Under the GDPR, you have the right to:

– request access to your personal data;

– rectify your personal data;

– request your personal data to be erased;

– request the restriction of your personal data processing;

– request the transfer of your personal data.

The Controller shall inform you without undue delay – and in any event within one month of receiving your request – of the action taken in respect of your request. Where necessary, the one-month period may be extended by a further two months due to the complexity of the request or the number of requests.

In any event, the Data Controller shall inform you of such extension within one month of receipt of the request, stating the reasons for the delay.

Right of access to personal data (Art. 15 of the GDPR)

You have the right to obtain information from the Data Controller as to whether your personal data is being processed.

If the Administrator is processing your personal data, you have the right to:

– access your personal data;

– obtain information on the purposes of the processing, the categories of personal data processed, the recipients or categories of recipients of such data, the intended period of storage of your data or the criteria for determining that period, your rights under the GDPR and your right to lodge a complaint with the supervisory authority, the source of the data, automated decision-making, including profiling, and the safeguards applied in connection with the transfer of such data outside the European Union;

– obtain a copy of your personal data.

Right to rectification of personal data (Art. 16 of the GDPR)

If your personal data is incorrect, you have the right to request the Controller to rectify your personal data immediately.

You also have the right to request the Controller to supplement your personal data.

Right to erasure of personal data, the so-called “right to be forgotten” (Art. 17 of the GDPR)

You have the right to request the Data Controller to erase your personal data when:

– your personal data is no longer necessary for the purposes for which it was collected or otherwise processed;

– you have withdrawn a specific consent, to the extent that the personal data was processed on the basis of your consent;

– your personal data has been unlawfully processed;

– you have objected to the processing of your personal data for direct marketing purposes, including profiling, to the extent that the processing of your personal data is related to direct marketing;

– you have objected to the processing of your personal data in connection with processing necessary for the performance of a task carried out in the public interest or processing necessary for the purposes of the legitimate interests pursued by the Controller of the personal data or by a third party.

Despite your request for erasure, the Controller may continue to process your personal data in order to establish, assert or defend your claims, of which you will be informed.

Right to request the restriction of personal data processing (Art. 18 of the GDPR)

You have the right to request the restriction of the processing of your personal data when:

– you question the correctness of your personal data – the Controller will restrict the processing of your personal data for a period of time enabling the verification of its correctness;

– the processing of your data is unlawful and you request the restriction of the processing of your personal data instead of its erasure;

– your personal data is no longer needed for the purposes of the processing but it is needed to establish, assert or defend your claims;

– you have objected to the processing of your personal data – until such time as it is ascertained whether the legitimate interests pursued by the Controller override the grounds set out in your objection.

Right to object to personal data processing (Art. 21 of the GDPR)

You have the right to object at any time to the processing of your personal data, including profiling, in relation to:

– processing necessary for the performance of a task carried out in the public interest or processing necessary for the purposes of the legitimate interests pursued by the Controller of the personal data or by a third party;

– processing for direct marketing purposes.

Right to request the transfer of personal data (Art. 20 of the GDPR)

You have the right to receive your personal data from the Controller in a structured, commonly used machine-readable format and to send it to another controller.

You may also request the Data Controller to directly send your personal data to another data controller (as far as this is technically possible).

Right to withdraw consent
